A witness who saw a baby crawling out an open window on the second story to the roof was saved and the parent swh were not supervising are in jail tonight.
Village of Bath Police charged Joseph R. Bennett, 38, and Destiny E. Smith, 30, both of Bath, with first-degree Class D felony reckless endangerment, two counts of endangering the welfare of a child and failure to provide sustenance to two dogs, a state agriculture and market law violation.
Police said children were allegedly left unsupervised in a home on Chestnut Street and a 10-month-old child crawled out of a second floor window and nearly onto the roof while Bennett and Smith were home.
A witness was able to run into the apartment, climb up on the roof and save the baby from falling, police said.
During the investigation, police said there were two dogs in the home that had not had food and water.
Bennett and Smith were processed and sent to the Steuben County Jail for a CAP arraignment where they were sent to jail without bail.
A search warrant was conducted and the Bath Police Department was assisted by the Steuben County Sheriff’s Office and Child Protective Services.
The children are in the care of a third party, police said, and the dogs have been seized and taken care of by animal rescue services.
Police also said several bystanders were instrumental in the safety of the children at the scene.
