Matthew David Marvin, 38 of Perinton NY faces up to 30 years in prison
ROCHESTER, N.Y.-U.S. Attorney Michael DiGiacomo announced today that Matthew David Marvin, 38, of Perinton, NY, was arrested and charged by criminal complaint with production and attempted production, receipt and possession of child pornography, which carry a mandatory minimum penalty of 15 years in prison and a maximum of 30 years.
According to the criminal complaint, on June 7, 2026, the Monroe County Sheriff’s Office was alerted to nude photographs of a 12 year old minor victim found on a laptop computer, which was taken into the custody by the Sheriff’s Office. Subsequent investigation traced the laptop and the photographs to Marvin. The complaint states that the videos were taken using a camera stored in the ceiling of a bathroom in Marvin’s home. On June 19, 2026, during a forensic analysis of the laptop, investigators recovered five video files depicting the same bathroom and females using the bathroom, one of whom appeared to be a naked minor.
On June 26, 2026, a search warrant was executed at Marvin’s residence, during which investigators seized numerous electronic items, including a desktop computer, two hard drives and Marvin’s cell phone. A forensic analysis of the electronic items recovered several thousand images and video files consistent with being recorded from a camera inside of a bathroom. The images and videos appeared to be recorded over a nearly three year period of time. Additional images and videos of child pornography obtained via the internet, as well as search terms and websites associated with child pornography, were located on the devices.
Marvin made an initial appearance before U.S. Magistrate Judge Mark W. Pedersen and was held pending a detention hearing on November 3, 2026.
The case is being prosecuted by Assistant U.S. Attorney Katelyn M. Hartford. The complaint is the result of an investigation by the Monroe County Sheriff’s Office, under the direction of Sheriff Todd Baxter and Homeland Security Investigations, under the direction of Acting Special Agent-in-Charge Anthony Patrone.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
